Concordia reportedly took ill-fated route before

Captain Francesco Schettino, the man accused of causing the deadly wreck of a cruise ship off the coast of Italy, is out of jail and under house arrest, as additional bodies were found aboard the capsized ship. NBC's Michelle Kosinski reports.

By msnbc.com and news services

Updated at 11:40 a.m. ET:?The Costa Concordia took a nearly identical route past Giglio Island in August to the one Friday that led to the sinking of the ship, NBC News has learned.

Adam Smallman, editor of shipping magazine Lloyd?s List, said the route taken in August, based on satellite tracking, was ?authorized by the company and the coast guard.?

"Our assessment of the route this vessel took (in August) is it must?have come perilously close, and?I mean possibly within touching distance of the rock that it hit this time ... which the company is saying wholly unauthorized in terms of its proximity to the island," Smallman said.

The search for missing passengers aboard the Costa Concordia is on hold over fears that the ship is shifting, making rescue efforts more dangerous.

The first victim was officially identified on Wednesday as Sandor Feher, a 38-year-old violinist from Hungary working aboard the ship. Hungarian ministry spokesman Jozsef Toth said the body was found inside the wreck and identified by his mother in the Italian city of Grosetto.

Jozsef Balog, a pianist who worked with Feher, told the Budapest newspaper Blikk that Feher was wearing a lifejacket when he decided to return to his cabin to pack his violin. Feher was last seen on deck en route to a lifeboat. According to Balog, Feher helped put lifejackets on several crying children before returning to his cabin.

The Costa Concordia ran aground Jan. 13 off the coast of Italy, resulting in the evacuation of thousands of passengers as the ship began heavily listing.

The captain in charge of the specialist divers searching the stricken Costa Concordia tells NBC News that they need to blow four more holes in it to gain access to the bottom of the cruise ship. Asked about the search for bodies -- some 23 people are unaccounted for according to Reuters -- the captain said there was visual evidence suggesting some bodies were at the bottom of the sea.

NBC News, citing officials involved in the rescue effort,?reported that on Wednesday the ship had sunk 1.5 meters (4.9 feet) at the front and 1 meter (3.2 feet) at the back, raising concerns that the vessel may break up in the middle.

The coast guard is monitoring shifts with sensors installed by divers at the start of the rescue mission, and that movement is its main concern as it could trap divers. By late afternoon, officials still did not have enough data to reassure them that the ship had stopped resettling.

"The visibility is awful. Yesterday I couldn't see my hand in front of my face," Giuseppe Minciotti, director of a school for cave divers in the northern city of Verona and part of the specialist team deployed on the wreck, told Reuters.

"I grabbed a piece of floating debris, and I couldn't see what it was until I had my head out of the water. It was a woman's shoe," he said.? "We're waiting today for new openings to be made, and we'll see if the visibility is any better in those points."

Jim Fee, a yacht skipper for three decades, discusses the potential ecological problems related to the Costa Concordia disaster. NBC's Harry Smith reports.

Coast guard spokesman Cosimo Nicastro said work would focus on an evacuation assembly area on the partially submerged fourth deck, where most of the 11 bodies found so far have been located.

"It's where we have already found seven of the bodies and it's where the passengers and crew gathered to abandon ship," Nicastro said.

Fire services spokesman Luca Cari said the search was suspended at about 8 a.m. local time (11 p.m. ET) after a shift of a few inches, posing a potential threat to diving teams operating in the submerged spaces of the ship.

There was no word on when work might resume.?

The Costa Concordia had more than 4,200 passengers and crew on board when it slammed into a reef Friday off the tiny Tuscan island of Giglio after Capt. Francesco Schettino made an unauthorized maneuver from the ship's programmed course ? allegedly to show off the luxury liner to the island's residents.

Rescue workers discovered five bodies on Tuesday, bringing the death toll of the Costa Concordia accident to 11.?

The adult bodies, believed to be passengers, were all wearing life jackets and were found in the rear of the ship near an emergency evacuation point, according to Nicastro.

Schettino, whose actions during the disaster have come under intense scrutiny as details of his role on the night of the disaster emerge, appeared before a judge in Grosseto, Tuscany,?where he was questioned for three hours. Schettino remains under house arrest.

During a heated conversation the Italian coast guard told the captain of the Costa Concordia to go back to the ship. NBC's Michelle Kosinski reports.

Schettino's lawyer, Bruno Leporatti, said urine and hair samples have been taken from Schettino, apparently to determine if he might have consumed alcohol or used drugs before the accident.

Leporatti also told a news conference in Grosetto that house arrest made sense given there was no evidence the captain intended to flee. He cited the fact that the captain coordinated the evacuation from the shore after leaving the ship.

"He never left the scene," Leporatti said. "There has never been a danger of flight."

Leporatti added the captain was upset by the accident, contrary to depictions in the Italian media that he did not appear to show regret.

"He is a deeply shaken man, not only for the loss of his ship, which for a captain is a grave thing, but above all for what happened and the loss of human life," the lawyer said.

Martino Pellegrino, a crew-member on Costa Concordia, described Schettino as "authoritarian," "stubborn" and "egocentric," in an?interview with Italian newspaper La Republica on Tuesday.

"Schettino likes to be in control of the ship's wheel," he told the newspaper.

Also on Tuesday, a transcript of a conversation between Schettino and Capt. Gregorio De Falco of the Italian coast guard in Livorno, showed the coast guard official urgently commanding the captain to return to the cruise ship after he had abandoned it.

"There are people trapped on board," De Falco said. "Now you go with your boat under the prow on the starboard side. There is a pilot ladder. You will climb that ladder and go on board. You go on board and then you will tell me how many people there are. Is that clear? I'm recording this conversation, Cmdr. Schettino ..."

Passengers continued to make their way home, with consistent claims that crew members were ill-prepared to handle an emergency evacuation.

"The crew members had no specialized training ? the security man doubled as the cook and bartender, so obviously they did not know what to do," passenger Claudia Fehlandt told Chile's Channel 7 television after being embraced by relatives at Santiago's airport.

"In fact, the lifeboats, even the ones that did get lowered, they did not know how to lower them and they cut the ropes with axes," she said.

"Commando: The Autobiography of Johnny Ramone" is set for release April 2 by Abrams Image.

His widow, Linda, says he started writing the book when he got sick. She said Tuesday, "It was like he knew he was dying, and he wanted to do something."

Iowa GOP voters see Romney as best Obama opponent

(AP) ? Former Massachusetts Gov. Mitt Romney won strong support Tuesday from Republicans seeking a candidate who can topple President Barack Obama in November's elections and from those most concerned about the weak economy, according to an entrance poll of GOP voters attending Iowa's presidential caucuses.

Rick Santorum, the former Pennsylvania senator, countered with solid backing from tea party supporters, religious voters and those who ranked abortion as their paramount campaign issue.

Each candidate's reservoir of support helped explain a night in which Romney and Santorum were running neck and neck ? and ahead of their four other competitors ? in the year's first votes as Republicans started selecting their presidential nominee.

Running third was Texas Rep. Ron Paul, who scored highly with young voters, independents and people concerned about huge federal budget deficits.

Given a choice of four qualities they wanted in their party's nominee, about 3 in 10 said they wanted someone who could defeat Obama this fall. Forty-nine percent of that group said they were backing Romney, more than twice as many as cited any other candidate.

"I like Santorum's character and values. But I like Romney's experience and record," said Jeff Young, a salesman from Waterloo, Iowa, who said he was split between the two before Tuesday's caucus. "He's best-positioned in the most ways to compete with the other party."

Santorum, whose candidacy surged in recent days while emphasizing family and faith, was leading among those seeking a candidate with strong moral character, with 39 percent picking him. Santorum and Paul, a libertarian, were running about evenly among those who said they wanted a true conservative as their standard bearer.

Nearly 3 in 10 supporters of the conservative tea party movement were supporting Santorum, and about the same proportion of born-again or evangelical voters were also backing him. That gave Santorum a clear lead among both groups, important because each account for about 6 in 10 Iowa GOP caucus goers.

Santorum's recent burst of popularity was spotlighted by the entrance poll, which showed he was backed by a third of all voters who said they made their decisions in recent days ? more than any other contender.

Only about 1 in 7 voters said abortion was the issue that mattered most when they picked a candidate, but an overwhelming 57 percent of them were backing Santorum.

Asked the campaign's top issue, about 4 in 10 named the economy. Romney led among that group with support from about a third of them, underscoring the appeal of his background running an investment company before entering politics and his emphasis during the campaign on his business experience.

Romney entered the caucuses widely viewed as the favorite to ultimately win his party's nomination, and the opinions expressed by voters in Tuesday's entrance poll underscored his strengths and weaknesses in the GOP contests ahead.

Besides his perceived strength as an Obama opponent and among those worried about the economy, Romney was running ahead of his rivals among the 42 percent of Iowa caucus voters who were not born again or evangelical Christians. He was also doing well among those age 65 and up, people earning $100,000 annually or more and the 53 percent who said a business background was more important than government experience to be an effective president.

But only 56 percent of Romney's backers voiced strong support for him, a weaker show of enthusiasm than his other chief rivals. He was also running poorly among those considering themselves very conservative, the most ardent tea party backers and born-again and evangelical voters ? a crucial portion of GOP voters in South Carolina and some other states in upcoming nominating contests.

Paul had the backing of 48 percent of voters under age 30 and nearly as many independents, giving him large leads in both categories. That could be good news for Paul in New Hampshire, where independents represented almost 4 in 10 voters in that state's 2008 GOP presidential primary. Nearly a quarter of Iowa's GOP voters Tuesday were independents, up from 2008, so their proportion in New Hampshire might grow this year as well.

About a third of GOP caucus goers said they were most concerned about budget deficits, and 3 in 10 of them picked Paul, more than any of his rivals.

Romney, Santorum, Paul and Texas Gov. Rick Perry were running roughly evenly among one-fourth of voters who said campaign advertising played an important role in choosing a candidate ? a testament to the millions in TV advertising that blanketed Iowa in the weeks leading up to Tuesday's caucuses.

The survey was conducted for AP and the television networks by Edison Research as voters arrived at 40 randomly selected caucus sites in Iowa. The survey involved interviews with 1,737 caucus-goers and had a margin of sampling error of plus or minus 4 percentage points.

CEO of debt collector pledges changes to industry

TULSA, Okla. (Legal Newsline) - Bill Bartmann, the chief executive officer of the Tulsa-based debt-collection agency CFS II, and other debt collectors have started a national reform initiative and have created a debt collector pledge.

In a press release, Bartmann said that standard debt collection is an abuse of the judicial process and it must stop. He added that the attorneys general of a number of states have cracked down on the scandalous behavior of debt collectors, including Darrell McGraw of West Virginia, Martha Coakley of Massachusetts, Lisa Madigan of Illinois, Greg Abbott of Texas, Roy Cooper of North Carolina and Lori Swanson of Minnesota.

"In the U.S. justice system, you're innocent until proven guilty," Bartmann said. "The same should be true in collections. Nine out of 10 times, customers want to pay you. If they do not, you need to start with the assumption that they have valid reasons."

In total, 216 debt collection companies have signed the pledge. The major elements of the document include never reselling credit card accounts to anyone who has not signed the pledge, never attempting to contact the consumer regarding credit card debt by telephone more than twice in a 24-hour period, never charging interest on a credit card that was charged off by the original issuer, never filing a lawsuit for collection of credit card debt and never attempting any collection effort on credit card debt that is beyond the statute of limitation.

"Debt collectors have developed some very nasty habits over the past five years or so," Bartmann said. "They sue millions of people every year based on nothing more than a name on a list. They mislead courts about facts they cannot prove. It is a practice of 'sue 'em all and let God sort them out.'"

Bartmann cited North Carolina as one of the states that has changed its laws to make debt collectors change their behavior. He said that he knows that his arguments and claims are unpopular in the debt collection industry and generate criticism from his competitors.

"My goal is not popularity," Bartmann said. "My goal is to make debt collectors treat consumers in a civilized manner."

Bartmann's debt collection company, CFS II, is located in Tulsa in the CityPlex Towers.
