Retailers sue Pfizer, charge generic Lipitor delay

TRENTON, N.J. (AP) ? Five large drug and grocery chains are suing Pfizer Inc. and a second drugmaker, alleging they conspired to delay sales of cheap generic versions of the blockbuster cholesterol drug Lipitor.

Lipitor, the world's top-selling drug ever, had peak sales of nearly $13 billion a year several years ago. Sales dropped sharply after it got U.S. generic competition on Nov. 30.

The lawsuit, filed Thursday by Walgreen Co., the Kroger Co. and three other retailers in U.S. District Court in Trenton, N.J., claims generics should have been available nearly two years earlier, when Lipitor's original patent expired.

The suit accuses Pfizer of patent fraud as well as "illegal, anti-competitive conduct" with generic drugmaker Ranbaxy Laboratories of India to block other generic drugmakers from selling versions of Lipitor, called atorvastatin calcium, until recently.

The suit also accuses New York-based Pfizer of making deals with companies that manage prescription benefits, giving them big discounts on brand-name Lipitor in exchange for those companies limiting sales of generic versions. Generic pills generally bring pharmacies higher profit margins than brand-name medicines do.

Pfizer denies the lawsuit claims and said Friday that it "will defend itself vigorously." A spokesman for Ranbaxy said the company had not been served with the lawsuit and has a policy against commenting on pending litigation.

The plaintiffs, which include Safeway Inc., Supervalu Inc. and HEB Grocery Co. LP, claim the original patent for the active ingredient in Lipitor expired in March 2010 and that Pfizer fraudulently got the U.S. Patent and Trademark Office to grant a follow-on patent that extended Pfizer's monopoly on Lipitor sales.

According to Pfizer, Lipitor has additional patents that run until 2017, in addition to the patent in question in the lawsuit.

The plaintiffs also accuse Pfizer and Ranbaxy of striking a deal to delay competition from other generic versions of Lipitor. Ranbaxy got a six-month window through the end of May when it sold generic Lipitor and the only other generic version on the market was an authorized one ? pills manufactured by Pfizer and sold by its partner, Watson Pharmaceuticals Inc.

"We are confident that Pfizer's procurement and enforcement of its Lipitor patents was at all times proper and lawful," Pfizer said in a statement. "The Lipitor patent settlements, including the settlement with Ranbaxy, were submitted for review by the U.S. Federal Trade Commission and are proper and lawful in all respects."

The lawsuit claims that due to the defendants' "scheme to delay and suppress generic Lipitor competition, in whole or in part, plaintiffs have paid hundreds of millions of dollars more for atorvastatin calcium than they would have paid absent such conduct."

Pfizer's revenue from brand-name Lipitor fell about 40 percent in the first quarter of this year, to $1.4 billion. That amount likely would have dropped more, if Pfizer had not offered the discounts to prescription benefit managers, along with copayment cards that helped about 750,000 patients to stay on brand-name Lipitor for just $4 per month.

The plaintiffs are seeking triple damages plus court and attorney costs. Their attorney, Deborah S. Corbishley of Miami, did not immediately respond to a request for comment.

Pfizer shares closed Friday trading down 13 cents to $22.54. The stock has changed hands between $16.63 and $23.30 in the past 52 weeks.

Leadership Victoria volunteers build community tool shed

For a tool shed built by a gang of white-collar workers, it looks unexpectedly sturdy and cleanly designed.

It?s walls are lined with all manner of tools ??pliers, screwdrivers, pliers, grips, extension cords, levels, rakes, shovels and hoses, and even has earthquake kits. It a handyman?s dream and a first shot at making a community tool shed within a Capital Region Housing Corporation townhouse complex.

The community tool shed was conceived and built by a six-person team within a Leadership Victoria 2012 class, modelled on a similar tool sharing project out of Portland, Ore.

In partnership with CRHC, the LifeCycles non-profit group was starting a community garden at the Cloverdale Avenue site, so a community tool shed seemed a perfect fit for 26 families in the complex and 26 seniors in an adjacent building.

Over the course of the project from September to May, the Leadership Victoria team fundraised money, had the tools donated, and even had time and expertise donated from a contractor and building designer. The six, who are mainly managers and professionals, also put in sweat and labour.

?There were a lot of weird snags,? said Blair Spencer, a provincial probation officer and who speaks for the team. ?There is kind of an underground stream here. You dig holes and they fill with water. There was a lot of trial by error.

?It was an ongoing joke about six white-collar workers choosing a gritty construction project,? he added. ?It definitely took us out of our comfort zone, but part of the program was meant to push our comfort zones.?

Residents at the complex supported the project and were keen to have gardening tools available, but the uptake on borrowing has been slow. Dawn Kennedy, a resident and one of the four people who volunteered to oversee tool checkout, expects when and if warmer weather arrives, people will start doing more home and garden projects.

?It?s really good for the people around here who don?t have a lot of stuff.? I don?t carry a lot of tools in my house ,? Kennedy said. ?It helps fosters a sense of community. And my kids love digging in the gardens, digging for the worms.?

Amy Jaarsma, a senior manager with CRHC, said community tool sheds is something they?d like to see at other housing sites.

?This is the first tool shed for our properties,? Jaarsma said. ?We might try it again once we get a feel for it. It would be great to try out in a different location.

?We need to have a site that is big enough that people will use it. It?s got to be something driven by tenants. It?s got to be something they want to do.?

Other Leadership Victoria teams also completed community projects, including healthy cooking classes with youth connected to Big Brothers Big Sisters; a Stigma Stomp Day with Bipolar Disorder Society of B.C. at Centennial Square on May 14; a program to teach youth the sources of food, how to purchase healthy food from grocery stores and how to prepare it, in collaboration with local chefs.

NRA Asks Candidates to Choose: Us or GOP Leadership

The National Rifle Association wants Tennessee legislative candidates to declare whether they will back Republican leaders or the NRA next year if that's what it takes to put a controversial guns-in-parking lots bill up for a full vote, reports the Chattanooga Times-Free Press.

In a gun-issues survey sent to Republican and Democratic candidates, the NRA devotes two of 27 questions to the Safe Commute Act, which cleared most committees but never came up for House and Senate floor votes this year.

The NRA-backed bill, as amended, sought to block public and private employers' ability to bar workers, customers and most visitors from keeping firearms in locked vehicles on company property, provided the weapons are stored out of sight.

The survey asks candidates if they would support the bill and blames Republican leaders for blocking full House and Senate votes this year.

"As a legislator, would you follow the demands of party leadership even if they run contrary to the NRA's legislative agenda?" the survey asks.

In an interview, NRA spokesman Andrew Arulandandam called the survey question "pretty straightforward and self-explanatory."

"At the NRA we're not shy. We don't mince words," he said.

....House Majority Leader Gerald McCormick, R-Chattanooga, said the survey question "sounds like they were asking, 'Will you do what we tell you to do instead of sticking by leadership?'"

...When Democrats controlled the General Assembly, the NRA routinely criticized leadership for bottling up gun bills.

This election cycle, Democrats aren't shedding any tears for the GOP chieftains.

"It's the residue of the Republicans promising the moon [while in the minority], knowing they couldn't deliver anything" Senate Democratic Leader Jim Kyle of Memphis said. "And now that they're piloting the space shuttle, it's different."

Switching metaphors, Kyle said, "It's the chickens coming home to roost."

Vicente Padilla fired back at Mark Teixeira after Saturday?s Yankees-Red Sox doublelehader, saying his former Rangers teammate is ?scared to face me? and claiming ?he?d be better off playing a women?s sport.?

Teixeira said Friday that Padilla ?doesn?t have too many friends in the game? and suggested that he be suspended for his head-hunting.

Padilla responded in a Spanish-language interview on NESN:

?The problem is he talks about all the wrong things that others have done, but the things he?s done ? against the Latinos [on the Rangers] ? he doesn?t open his mouth about,? Padilla said. ?He once threatened me and said he was going to hit me with a bat, and that?s when we were playing on the same team.

?And then, he also had problems with Frank Francisco, our closer back then. But he doesn?t talk about that, does he? Then, of course, he goes on and makes those comments about me.?

It sounds like Padilla has some legitimate beefs with Teixeira, but he?s not going into detail here. Plus, whatever the beef, his closing comments won?t go over well.

?In this sport, as competitive ball players, we get pretty fired up,? Padilla said. ?So I think, maybe, [Teixeira] picked the wrong profession. I think he?d be better off playing a women?s sport.?

Just a guess here, but Padilla probably doesn?t watch a lot of women?s sports.
