Train derailment sends chemical tankers into N.J. creek

PAULSBORO, N.J. (AP) ? Authorities say only one of the derailed train cars in southern New Jersey has leaked hazardous material.

The Department of Environmental Protection says the car leaked vinyl chloride as a gas and all of it has since dissipated.

The chemical can cause nausea and breathing problems.

Several tanker cars derailed in the accident Friday morning on a rail bridge in Paulsboro and toppled into a creek. Part of the bridge has buckled but the full extent of the damage is not yet known.

Officials at Underwood-Memorial Hospital say 11 people have been transported with complaints related to the derailment and five more arrived on their own. The hospital's communication's office says all are believed to have complained of having respiratory problems.

Residents in three towns were told to stay inside after the derailment.

The cause of the accident hasn't been determined.

Proteins that work at the ends of DNA could provide cancer insight

ScienceDaily (Nov. 29, 2012) ? New insights into a protein complex that regulates the very tips of chromosomes could improve methods of screening anti-cancer drugs.

Led by bioengineering professor Sua Myong, the research group's findings are published in the journal Structure.

Myong's group focused on understanding the proteins that protect and regulate telomeres, segments of repeating DNA units that cap the ends of chromosomes. Telomeres protect the important gene-coding sections of DNA from loss or damage, the genetic equivalent of aglets -- the covering at the tips of shoelaces that keep the ends of the laces from unraveling or fraying.

Telomeres play an important role in cell aging and death, since each time a cell divides, a little bit is lost from the end of the telomere. Thus, cell biologists postulate that telomere length can determine the lifespan of a cell. Cancer cells, however, have a way to get around this limitation: An enzyme called telomerase that adds length to telomeres is highly active in cancer cells. This allows cancer cells to divide in perpetuity, running amok through tissues and systems.

"Cancer researchers want to get a hold of this problem, control this indefinite lengthening of the telomeres," said Myong, who also is affiliated with the Institute for Genomic Biology at the U. of I. "A lot of the anti-cancer drugs are targeted directly to these telomeres so that they can inhibit telomerase activity. The proteins we study regulate the activity of telomerase."

Using a technique developed at Illinois that allows researchers to watch single molecules interact in real time, Myong's group determined how two proteins called POT-1 and TTP-1 bind to the telomere. POT-1 protects the fragile telomere ends from being attacked by other regulatory proteins that might mistake the end for a broken or damaged area of DNA. When POT-1 and TTP-1 work together in a complex, they promote telomerase activity, an interesting target for cancer researchers.

The group found that on its own, POT-1 binds to the folded-up telomere in distinct steps at particular points in the telomere's DNA sequence, unfolding the telomere in a stepwise manner. However, the POT-1/TTP-1 complex surprised the researchers by binding, then freely sliding back and forth along the telomere end.

"Instead of stepwise binding, what we saw was a mobile protein complex, a dynamic sliding motion," Myong said. "Somehow it was as if the static binding activity of POT-1 is completely lost -- the protein complex just slid back and forth. We were able to reproduce the data and confirm it with many different tail lengths of the telomeric DNA and we know now that the contact between POT-1 and the telomere is somehow altered when the partner protein comes and binds."

Next, the researchers will add telomerase and see how the sliding activity of the POT-1/TTP-1 complex affects telomerase activity. Myong postulates that the sliding may promote telomerase activity -- and thus telomere lengthening -- by making the end of the telomere accessible for the telomerase enzyme to bind.

"We are excited about the possibility that this kind of mobility can increase the telomerase extension activity," Myong said. "It's somehow engaging the enzyme so that it can stay bound to the DNA longer. So it must involve a direct interaction."

Ultimately, understanding the POT-1/TTP-1 complex gives drug developers a new target for anti-cancer drugs, and the assay Myong's group used to monitor the complex could offer a venue for evaluating telomere-targeting drugs.

"We want to extend our a basic science knowledge in telomere biology into causes of cancer and we hope that our assay can be useful for telomere-targeted drug screening," Myong said.

Two winners in record Powerball jackpot

Winning tickets for the record Powerball jackpot worth more than $587 million were purchased in Arizona and Missouri.

Missouri Lottery official Susan Goedde confirmed to ABC News this morning that one of the winning tickets was purchased in the state, but they would not be announcing a town until later this morning.

Arizona lottery officials said they had no information on that state's winner or winners but would announce where it was sold during a news conference later in the day.

The winning numbers for the jackpot were 5, 23, 16, 22 and 29. The Powerball was 6.

The jackpot swelled to $587.5 million, according to Lottery official Sue Dooley. The two winners will split the jackpot each getting $293.75 million.

An additional 8,924,123 players won smaller prizes, according to Powerball's website.

"There were 58 winners of $1 million and there were eight winners of $2 million. So a total of $74 million," said Chuck Strutt, Director of the Multi-State Lottery Association.

Hopeful players bought tickets at the rate of 131,000 every minute up until an hour before the deadline of 11 p.m. ET, according to lottery officials.

The jackpot had already rolled over 16 consecutive times without a winner. That fact, plus the doubling in price of a Powerball ticket, accounted for the unprecedented richness of the pot.

"Back in January, we moved Powerball from being a $1 game to $2," said Mary Neubauer, a spokeswoman at the game's headquarters in Iowa. "We thought at the time that this would mean bigger and faster-growing jackpots."

That proved true. The total, she said, began taking "huge jumps -- another $100 million since Saturday." It then jumped another $50 million.

The biggest Powerball pot on record until now -- $365 million -- was won in 2006 by eight Lincoln, Neb., co-workers. As the latest pot swelled, lottery officials said they began getting phone calls from all around the world.

"When it gets this big," said Neubauer, "we get inquiries from Canada and Europe from people wanting to know if they can buy a ticket. They ask if they can FedEx us the money."

The answer she has to give them, she said, is: "Sorry, no. You have to buy a ticket in a member state from a licensed retail location."

About 80 percent of players don't choose their own Powerball number, opting instead for a computer-generated one. Asked if there's anything a player can do to improve his or her odds of winning, Neubauer said there isn't -- apart from buying a ticket, of course.

Lottery officials put the odds of winning this Powerball pot at one in 175 million, meaning you'd have been 25 times more likely to win an Academy Award.

Skip Garibaldi, a professor of mathematics at Emory University in Atlanta, provided additional perspective: You are three times more likely to die from a falling coconut, he said; seven times more likely to die from fireworks, "and way more likely to die from flesh-eating bacteria" (115 fatalities a year) than you are to win the Powerball lottery.

Segueing, then, from death to life, Garibaldi noted that even the best physicians, equipped with the most up-to-date equipment, can't predict the timing of a child's birth with much accuracy.

"But let's suppose," he said, "that your doctor managed to predict the day, the hour, the minute and the second your baby would be born."

The doctor's uncanny prediction would be "at least 100 times" more likely than your winning.

Even though he knows the odds all too well, Garibaldi said he usually plays the lottery.

When it gets this big, I'll buy a couple of tickets," he said. "It's kind of exciting. You get this feeling of anticipation. You get to think about the fantasy."

So, did he buy two tickets this time?

"I couldn't," he told ABC News. "I'm in California" -- one of eight states that doesn't offer Powerball.

In case you were wondering, this Saturday's Powerball jackpot is starting at $40 million.

Installed price of solar photovoltaic systems in US continues to decline at rapid pace

ScienceDaily (Nov. 27, 2012) ? The installed price of solar photovoltaic (PV) power systems in the United States fell substantially in 2011 and through the first half of 2012, according to the latest edition of Tracking the Sun, an annual PV cost-tracking report produced by the Department of Energy's Lawrence Berkeley National Laboratory (Berkeley Lab).

The median installed price of residential and commercial PV systems completed in 2011 fell by roughly 11 to 14 percent from the year before, depending on system size, and, in California, prices fell by an additional 3 to 7 percent within the first six months of 2012. These recent installed price reductions are attributable, in large part, to dramatic reductions in PV module prices, which have been falling precipitously since 2008.

The report indicates that non-module costs -- such as installation labor, marketing, overhead, inverters, and the balance of systems -- have also fallen significantly over time. "The drop in non-module costs is especially important," notes report co-author Ryan Wiser of Berkeley Lab's Environmental Energy Technologies Division, "as these costs can be most readily influenced by local, state, and national policies aimed at accelerating deployment and removing market barriers." According to the report, average non-module costs for residential and commercial systems declined by roughly 30 percent from 1998 to 2011, but have not declined as rapidly as module prices in recent years. As a result, non-module costs now represent a sizable fraction of the installed price of PV systems, and continued deep reduction in the price of PV will require concerted emphasis on lowering the portion of non-module costs associated with so-called "business process" or "soft" costs.

The report indicates that the median installed price of PV systems installed in 2011 was $6.10 per watt (W) for residential and small commercial systems smaller than 10 kilowatts (kW) in size and was $4.90/W for larger commercial systems of 100 kW or more in size. Utility-sector PV systems larger than 2,000 kW in size averaged $3.40/W in 2011. Report co-author Galen Barbose, also of Berkeley Lab, stresses the importance of keeping these numbers in context, noting that "these data provide a reliable benchmark for systems installed in the recent past, but prices have continued to decline over time, and PV systems being sold today are being offered at lower prices."

Based on these data and on installed price data from other major international PV markets, the authors suggest that PV prices in the United States may be driven lower through large-scale deployment programs, but that other factors are also important in achieving installed price reductions.

The market for solar PV systems in the United States has grown rapidly over the past decade, as national, state and local governments offered various incentives to expand the solar market and accelerate cost reductions. This fifth edition in Berkeley Lab's Tracking the Sun reportseries describes historical trends in the installed price of PV in the United States, and examines more than 150,000 residential, commercial, and utility-sector PV systems installed between 1998 and 2011 across 27 states, representing roughly 76 percent of all grid-connected PV capacity installed in the United States. Na?m Darghouth, also with Berkeley Lab, explains that "the study is intended to provide policy makers and industry observers with a reliable and detailed set of historical benchmarks for tracking and understanding past trends in the installed price of PV."

Prices Differ by Region and by Size and Type of System

The study also highlights the significant variability in PV system pricing, some of which is associated with differences in installed prices by region and by system size and installation type. Comparing across U.S. states, for example, the median installed price of PV systems less than 10 kW in size that were completed in 2011 and ranged from $4.90/W to $7.60/W, depending on the state.

It also shows that PV installed prices exhibit significant economies of scale. Among systems installed in 2011, the median price for systems smaller than 2 kW was $7.70/W, while the median price for large commercial systems greater than 1,000 kW in size was $4.50/W. Utility-scale systems installed in 2011 registered even lower prices, with most systems larger than 10,000 kW ranging from $2.80/W to $3.50/W.

The report also finds that the installed price of residential PV systems on new homes has generally been significantly lower than the price of similarly sized systems installed as retrofits to existing homes, that building integrated PV systems have generally been higher priced than rack-mounted systems, and that systems installed on tax-exempt customer sites have generally been priced higher than those installed at residential and for-profit commercial customer sites.

Price Declines for PV System Owners in 2011 Were Offset by Falling Incentives

State agencies and utilities in many regions offer rebates or other forms of cash incentives for residential and commercial PV systems. According to the report, the median pre-tax value of such cash incentives ranged from $0.90/W to $1.20/W for systems installed in 2011, depending on system size. These incentives have declined significantly over time, falling by roughly 80 percent over the past decade, and by 21 percent to 43 percent from just 2010 to 2011. Rather than a direct cash incentive, some states with renewables portfolio standards provide financial incentives for solar PV by creating a market for solar renewable energy certificates (SRECs), and SREC prices have also fallen dramatically in recent years. These declines in cash incentives and SREC prices have, to a significant degree, offset recent installed price reductions, dampening any overall improvement in the customer economics of solar PV.

Creating dark walls does not mean you have to choose the darkest possible shade. It simply means you should make use of a shade that is darker than that of the furniture. Keep with like shades, furniture typically comes in warm shades. Mixing warm and cool colors will have an overall disjointed affect to your room.

Colors that are alike go well together, such as a light green or violet companied with a soft sky blue. If they were to be paired with a shade of red, orange or yellow, the room could come across as chaotic, with nowhere for the eye to detect any pattern. Keeping warm colored fabric together, such as oranges, yellows and reds, promises a pleasant overall design.

Now that you have decided on dark walls and light furniture, it is time to add the trims and such to the room. Typically, a rug will match the walls with the curtains balancing the room out by being comprised of?fabrics, which are a closer match to the furniture. Finally, the molding and baseboards trims are often in off-white. However, it is okay to introduce another color element as long as the room is not becoming overloaded with too much color.

World ? China considering changes to its one-child policy

BEIJING ?

China is mulling changes to its one-child policy, a former family planning official said, with government advisory bodies drafting proposals in the face of a rapidly aging society in the world?s most populous nation.

Proposed changes would allow for urban couples to have a second child, even if one of the parents is themselves not an only child, the China Daily cited Zhang Weiqing, the former head of the National Population and Family Planning Commission, as saying on Wednesday.

Under current rules, urban couples are permitted a second child if both parents do not have siblings. Looser restrictions on rural couples means many have more than one child.

Population scholars have cited mounting demographic challenges in their calls for reform of the strict policy, introduced in 1979 to limit births in China, which now has 1.34 billion people.

Zhang said the commission and other population research institutes have submitted policy recommendations to the government.

Zhang, who now serves on China?s congressional advisory body, said any changes if adopted would be gradual.

?China?s population policy has always taken into account demographic changes but any fine-tuning to the policy should be gradual and consider the situation in different areas,? China Daily cited Zhang as saying.

The relaxed policy might be implemented first in ?economically productive regions? and places that have followed closely existing regulations, the paper said.

Demographers warn that the one-child policy has led to a rapidly greying population that could hamper China?s future economic competitiveness. Critics say it also has fueled forced abortions and increased social tensions stemming from an imbalance in the number of boys and girls born.

Though forced abortions are illegal in China, officials have long been known to compel women to have the procedures to meet birth-rate targets.

Earlier this year, debate over the country?s strict family planning rules erupted after a woman in the northwestern province of Shaanxi was forced by officials to abort her seven-month pregnancy.

The national economy runs through cycles similar to the fashion industry. Things that seem irresistible and trendy this year may be old news by the time next year rolls around. As a result of the economic down turn from the past few years most home builders are turning their attention to items that are practical instead of luxurious.

Sunrooms

As a whole, sunrooms are declining in popularity. According to Rose Quint, a representative of the National Association of Home Builders (NAHB) ?Builders are focusing on features that add immediate value and make a home more practical.? For example, most builders are choosing to add linen closets and walk-in closets in place of a sunroom.

Separate Living Room

Most builders feel that a formal living room will not be very prevalent in new construction for the upcoming year. Families would prefer to have one giant open area that encompasses the living room, dining room and kitchen.

Media Room

Along with the living room, the media room will also likely disappear. The extra cost of the equipment, along with heating and cooling another room that is used sparingly, is just not appealing at this time. What is more likely to appear in new homes is a hidden away station that holds all of the DVD players, cable controls and charging stations for cell phones, tablets, and other media devices.

Two Story Family Room and Foyer

Since builders are approaching new homes with more practicality, it makes sense to cut down on unused space. While a family room may be bigger in new homes to include the dining and kitchen areas, it is unlikely to be two stories tall. The same goes for the elegant foyers that stretch toward the sky with large windows. Both of these features of a home may be lovely in appearance, but they each have a lot of space that is not used by a family of four or more.

Whirlpool Bathtubs

A large tub designed for relaxation and luxury is less likely to part of a new construction in the upcoming year. A separate tub laid out in a classic style is more useful and can be used to make a fashion statement while also having an everyday use.

Luxury Bathroom

Large bathrooms that include walk-in showers and multiple shower heads, as well as lots of floor space, will be harder to find in a new house. Instead, the shower will be smaller, with a single head, and the kitchen will likely include a double sink.

Outdoor Kitchen

The outdoor kitchen will probably disappear from lots of new homes. While it can be a nice place to gather with friends or family for a birthday party or to watch a football game, it also requires having an extra appliance or two. Most families would rather prepare the food inside and simply transport it to the patio and save on the cost of the additional appliances.

Obama to meet executives, go to Pennsylvania for fiscal push

WASHINGTON (Reuters) - President Barack Obama will launch a multipronged push this week to garner support for his proposals to solve U.S. fiscal problems, meeting with business executives at the White House and visiting a small business in Pennsylvania to press his case.

Obama has sought to go on the offensive since his re-election on November 6 in the fight with Republicans over the "fiscal cliff" - a combination of tax increases and spending cuts that would go into effect next year if the two sides do not reach a deal to stop it.

As part of that effort, the White House released a report on Monday showing the impact that middle class tax increases would have on consumers and the retail industry.

On Tuesday, a White House official said, the president will meet with a group of small-business owners. On Wednesday he will host an event with "middle class Americans who would be impacted if Congress fails to act to extend the middle class tax cuts," the official said. He will also hold a meeting with business leaders, something he has done previously.

On Friday, he will visit a manufacturing facility of The Rodon Group, a small business that is a manufacturer for K'NEX Brands, a toy company with products including Tinkertoy and Angry Bird Building Sets.

"The president will travel to Montgomery County, Pennsylvania, to continue making the public case for action by visiting a business that depends on middle class consumers during the holiday season, and could be impacted if taxes go up on 98 percent of Americans at the end of the year," the official said.

Obama's visit and his meetings at the White House are designed to put pressure on congressional Republicans to extend tax cuts for middle-income people while ending them for families who make more than $250,000 a year.

Gaining the support of the business community is a key part of Obama's strategy. Reinforcing that, the White House released an analysis by its National Economic Council that said millions of small-business owners would suffer if the middle class taxes went up next year.

The iPad Data Security Lawsuit ? What's Next? - Internet Law Blog

On June 9th, 2010, Gawker.com ran a story about Andrew Auernheimer (a.k.a., weev) and Daniel Spitler (a.k.a., JacksonBrown), two hackers from the Goatse Security team (GoatSec). Five weeks after Apple?s 3G-enabled iPad was released, Auernheimer and Spitler uncovered a gaping security hole, singular to the 3-G hardware, which exposed personally identifiable information of AT&T customers.

Last week, one of the bug hunters was convicted on one count of conspiring to access a computer without authorization ? a violation of the Computer Fraud and Abuse Act (CFAA) ? and one count of fraud. To add insult to injury, his former hacking partner helped the prosecution. Auernheimer is appealing, which means this suit could eventually land in the hands of the Supreme Court.

Below is the story behind the lawsuit that could further solidify legal precedence regarding the Computer Fraud & Abuse Act.

What made the Auernheimer hacking lawsuit so intriguing to those in the Internet community was the fact that he did not, technically, hack into anything. Instead, he simply made a few simple guesses and then used his know-how to write a script. As such, the question arose: should he be guilty of essentially finding a webpage with no links pointing to it, and then using the information found therein?

The merits of the CFAA have been hotly debated in the wake of significant technological advancement. Primarily, pundits are concerned that the vague wording of the bill harshly punishes young kids, who are essentially committing the same level crime as toilet papering someone?s house, and useful bug hunters who don?t do anything nefarious with the data they uncover.

Under the current law, anybody who accesses ?a computer without authorization or exceeds authorized access from a protected computer? can be charged with a criminal offense. Moreover, any device that ?affects interstate commerce with a microprocessor and a network connection? is considered a ?protected computer.? As many have pointed out, that definition pretty much includes all mobile devices ? clearly, the CFAA is in need of some language adjustments.

When the trial was announced, GoatSec vowed that if ?weez? lost the case, they would release information on an encrypted ?insurance file.? The review, tabled in Parliament earlier this month, also heard officers were being forced to ?ramp? alongside ambulances while they waited at emergency departments to hand over the patients.

?Police will stay with the patient (at the ED) to ensure their safety and the safety of others until the patient received assessment and required medical attention,? review author Prof Bryant Stokes wrote.

?Police were concerned that on the occasions when they must use the police division van to take a patient to ED, they have to ramp with the ambulances.

?Officers cautioned and were concerned that they are not able to provide the patient with adequate assistance in this situation.?

Health Minister Kim Hames yesterday confirmed that on occasions police have to wait with ambulances to bring mentally ill patients into hospitals.

?The only way to truly alleviate ambulance ramping is to open more hospital beds, which we are doing as fast as we can,? Dr Hames said.

Police Union president George Tilbury said officers often waited for ?hours on end? at emergency departments and the current system was ?wasting vast amounts of valuable police resources?.

?This is unacceptable for people with mental health issues, police and the community,? Mr Tilbury said.

?Funding for mental health in this state is grossly inadequate and until such time as the Government commits significant additional resources, police have no option but to fill the void.?

WA Police is continually planning and backfilling roles when patients need to be transferred.

In some cases of long-distance transfers, officers are flown from Perth to country towns to escort a patient, the review was told.

The findings prompted a recommendation for a metropolitan-wide mental health transport system, similar to that operating in NSW.

Under the program, police provide assistance at initial contact and mental health-trained ambulance officers transport patients without police escorts.

Commander Fred Gere, from the Metropolitan Region office, said the agency was ?supportive of the findings from the report and look forward to working with the respective agencies in implementing the recommendations that involve police?.

UnitedHealth forecasts 2013 profit below Wall St view

(Reuters) - UnitedHealth Group Inc , the largest U.S. private health insurer, said on Monday it expects 2013 earnings of $5.25 to $5.50 per share, below analysts' expectations.

The outlook backs up comments the company made in October that analysts' estimates for 2013 were too high due to the weak economy and government efforts to rein in the deficit. At that time, the Wall Street consensus was for earnings of $5.60 per share.

UnitedHealth shares fell 93 cents, or 1.7 percent, to $53.01 in Monday morning New York Stock Exchange trading.

Revenue should be $123 billion to $124 billion next year, higher than the Wall Street target, UnitedHealth said in a statement ahead of a Tuesday meeting with analysts and investors.

Analysts had expected 2013 earnings of $5.58 per share on revenue of $119.12 billion, according to Thomson Reuters I/B/E/S.

"As expected, 2013 guidance seems conservative, but prudently so, as it's a first look at the year and there is still a cloud of uncertainty around the 'fiscal cliff' and debt ceiling issues," Sheryl Skolnick, an analyst at CRT Capital Group, said in a research note.

The fiscal cliff and debt ceiling issues could affect the economy and UnitedHealth's Medicare Advantage government health insurance program for older people, Skolnick said.

UnitedHealth has a history of beating its forecasts, Oppenheimer analyst Michael Wiederhorn said in a research note. He also said it was not immediately clear if the Wall Street consensus outlook for 2013 revenue was comparable and included sales from Brazil's Amil Participacoes SA . UnitedHealth is in the process of buying the Brazilian company for $4.9 billion.

UnitedHealth also reaffirmed its 2012 outlook for earnings of $5.20 to $5.25 per share.

Iran says missile deployment in Turkey would increase tensions

DUBAI (Reuters) - Iran said the deployment of Patriot defense missiles near Turkey's border with Syria would worsen tensions, as fears grow of the Syrian civil war spilling across the region.

Turkey asked NATO for the Patriot system, designed to intercept aircraft or missiles, last week after talks about how to shore up security on its 900-km (560-mile) border.

"The installation of such systems in the region has negative effects and will intensify problems in the region," Iranian parliament speaker Ali Larijani said on returning from a trip to Syria, Lebanon and Turkey on Saturday evening, according to Iranian state news agency IRNA.

Ramin Mehmanparast, Iran's foreign ministry spokesman, told the Iranian Students' News Agency (ISNA) on Sunday that deploying the Patriot system "will not only not help solve the situation in Syria, it will actually make the situation more difficult and complicated as well".

Syria has called Turkey's request for the Patriot missiles "provocative", and Russia said the move could increase risks in the conflict.

Iran has steadfastly supported Syrian President Bashar al-Assad throughout the 20-month-old uprising against his rule.

Turkey's missile request may have riled Damascus because it could be seen as a first step toward implementing a no-fly zone over Syrian airspace.

Syrian rebels have been requesting a no-fly zone to help them hold territory against a government with overwhelming firepower from the air, but most foreign governments are reluctant to get sucked into the conflict.

Turkey fears security on its border may crumble as the Syrian army fights harder to contain the rebels, some of whom have enjoyed sanctuary in Turkey.

Heavy fighting has often erupted along Syria's border with Turkey. Ankara has scrambled fighter jets and returned fire after stray Syrian shells and mortars landed in its territory.

Alabama shooter kills one sheriff's deputy, wounds another

(Reuters) - A man shot and killed one Alabama sheriff's deputy and critically wounded another when they went to his home near Fairhope on a report that he was acting aggressively toward family members, authorities said on Saturday.

The shooter, Michael Jansen, also was killed in the exchange of gunfire on Friday afternoon, the Baldwin County Sheriff's Office said in a statement.

Baldwin County Sheriff Huey Mack told reporters that the deputies responded to a report that Jansen had "been confrontational with some family members" and were speaking with him at his home near Fairhope, about 15 miles southeast of Mobile.

"While the deputies were on scene and talking to the individual, the individual produced a handgun and began firing at the deputies," Mack told reporters.

A third deputy at the scene was not wounded.

The two deputies suffered multiple gunshot wounds and were taken to USA Medical Center in Mobile, where Deputy Scott Ward was pronounced dead and the second deputy, who has not been identified, was listed in critical condition, the sheriff's office said.

Ward served as a sheriff's deputy for 15 years.

"I'm very proud of him, it's a big loss," Mack told reporters. "But he was doing his job and we'll pull together in a time like this and we'll honor his memory by carrying on."

The shooting is being investigated by the Baldwin County Major Crimes Task Force, he said.

Real estate promoter DeLoache was a Dallas legend back in the day

Dallas has always had its share of colorful real estate entrepreneurs.

Heck, a land speculator who died in the nut house founded the whole town.

Ira P. DeLoache at the Idlewild Ball in 1962.

But few local land jockeys have ever risen to the heights of Ira Pleasant DeLoache.

Born on a North Carolina plantation, DeLoache came to Dallas in 1903 to sell cigarettes.

He married the daughter of a prominent Texas cattleman and by the 1920s was doing real estate in Big D.

In the early years he developed a few buildings in downtown Dallas and along Knox Street near Highland Park.

And in 1924 DeLoache turned one his father-in-law?s ranch properties near Lubbock into the small town of Whiteface.

But DeLoache?s lasting success was the Dallas County town of Preston Hollow.

The area on the north side of Northwest Highway is now home to some of Dallas? most affluent neighborhoods.

Back in DeLoache?s day, it started out as just farmland with few roads and almost no utilities.

DeLoache built his little country real estate office in 1926 at the corner of Preston Road and Northwest Highway and began selling two-acre lots as ?rural home sites.?

By 1939, the area had incorporated as its own separate town.
Preston Hollow lasted as a stand-alone community for only about five years before residents voted to join with the city of Dallas.

But by then Ira DeLoache was already legendary in local real estate circles.

?I remember he wore a vicuna coat and a slouch hat and was charming as he could be,? said Mary Frances Burleson, CEO of Ebby Halliday Realtors which has owned DeLoache?s old Preston Road office since 1964.

Realtor Ebby Halliday remembers seeing DeLoache at the country club.

?He played gin rummy daily in the east room,? said Halliday, who will be 102 early next year. ?He would speed up Northwest Highway and Preston Road in his convertible.?

DeLoache died in 1965 at the age of 86.

We also propose lifting the ban on recruitment in the garda?, as local garda services have already been stretched to the limit.

It doesn't matter if the earth sways in Chile, Alaska or Japan, the formation of the sea floor along the U.S. West Coast generally aims any tsunami surges at the tiny California port town of Crescent City. Churning water rushes into the boat basin and then rushes out, lifting docks off their pilings, tearing boats loose and leaving the city's main economic engine looking as if it has been bombed.

That's what happened in March 2011, when a Japanese earthquake sparked a tsunami that sank 11 boats, damaged 47 others and destroyed two-thirds of the harbor's docks.

Port officials are hoping that tsunami is among the last of many that have forced major repairs in Crescent City, a tiny commercial fishing village on California's rugged northern coast. Officials are spending $54 million to build the West Coast's first harbor able to withstand the kind of tsunami expected to hit once every 50 years ? the same kind that hit in 2011, when the highest surge in the boat basin measured 8.1 feet (2.5 meters) and currents were estimated at 22 feet (6.7 meters) per second.

Officials are building 244 new steel pilings that will be 30 inches (76 centimeters) in diameter and 70 feet (21 meters) long. Thirty feet (9 meters) or more will be sunk into bedrock. The dock nearest the entrance will be 16 feet (5 meters) long and 8 feet (2.4 meters) deep to dampen incoming waves. The pilings will extend 18 feet (5.5 meters) above the water so that surges 7 ? feet (2.3 meters) up and 7 ? feet down will not rip docks loose.

Crescent City was not the only West Coast port slammed by the tsunami, which was generated by a magnitude-9.0 earthquake in Japan. The waves ripped apart docks and sank boats in Santa Cruz, California, and did similar damage in Brookings, Oregon, just north of Crescent City. But their geographical location doesn't make them as vulnerable to multiple tsunamis.

"Normally, Crescent City takes the hit for all of us," said Brookings harbormaster Ted Fitzgerald.

Since a tidal gauge was installed in the boat basin in 1934, this small port has been hit by 34 tsunamis, large and small. It typically suffers the most damage and the highest waves on the West Coast, said Lori Dengler, professor of geology at Humboldt State University.

The sea floor funnels surges into the mouth of Crescent City's harbor, and the harbor's configuration magnifies them, experts say.

A wave generated by an earthquake in Alaska on Good Friday, 1964, killed 11 people and wiped out 29 city blocks. That was 10 years before the boat basin was even built.

When the waves hit in 2011, the port was still repairing damages from a tsunami that hit in 2006. Officials already had a plan for dealing with future tsunamis, said Ward Stover, owner of Stover Engineering in Crescent City, which put together the plan.

With no tsunami building codes, Stover said the state of California and Crescent City decided to prepare for the kind of tsunami expected to hit every 50 years. They rejected as too expensive building a tidal gate to close off the mouth of the harbor or trying to survive a powerful tsunami like the one that hit in 1964. Instead, they planned to make the docks strong enough to ride out the most likely surges.

"It's tsunami-resistant, not tsunami-proof," Stover said.

Construction has been marked by one delay after another. Government funding was slow, and a custom-built drill bit for installing the extra-strength pilings deep in bedrock broke. So authorities switched to installing temporary docks the old-fashioned way, by pounding in the pilings, to get them through the winter. Many of the 60 commercial fishing boats based in Crescent City are still mooring in the outer harbor. Others have to make do without water or electricity.

The March 2011 tsunami was a wake-up call for communities up and down the West Coast. Many improved tsunami evacuation plans and held mock evacuations.

But some experts say the West Coast is still not taking the threat seriously enough.

"Many ports on the West Coast are in denial as to their tsunami hazard," said Costas Synolakis, professor of civil and environmental engineering and director of the Tsunami Research Center at the University of Southern California.

ASPCA Offers Deep Discounts On 'Cat Friday' ? CBS New York

NEW YORK (CBSNewYork/AP) ? It?s Cat Friday in New York City.

Not to be outdone by retail?s annual Black Friday, the ASPCA is offering ?deep discounts? on cat adoption fees.

?Adopting a pet is kind of like a gift you give to yourself that just keeps on giving,? said ASPCA Senior Vice President Gail Buchwald. ?A new TV or the latest kid?s toy can provide temporary entertainment, but bring home a pet and you?ll get a lifetime of joy.?

Cats over a year old will have their adoption fees waived, while kittens ? ages four months to one year ? will have an adoption fee of only $50. Normally, the adoption fee for kittens is $125.

All ASPCA pets are spayed or neutered, up to date on vaccinations, and microchipped.

Those who adopt a cat will also receive a free cat collar, ID tag and a cardboard carrier.

The ASPCA?s adoption center on the Upper East Side has extended its hours for the big day and will remain open until 10 p.m.

Butler holds off ninth-ranked UNC 82-71 in Maui

LAHAINA, Hawaii (AP) ? Maybe North Carolina should have just gone to the beach. Butler is the team to beat in Maui.

Rotnei Clarke and Kellen Dunham each scored 17 points Tuesday night to lead the unranked Bulldogs to an 82-71 win over No. 9 UNC in the second round of the Maui Invitational.

Butler jumped out to a 17-point halftime lead and held back several second-half surges from the Tar Heels.

"It was an entertaining game to be a part of," Butler coach Brad Stevens said. "When you are playing a program like Carolina, you know they are coming. Their run is coming next."

The runs sure came, but UNC was too far behind to make them worth anything.

"We just dug too big a hole against a very, very good team," North Carolina coach Roy Williams said.

The Tar Heels (4-1) missed their first three shots and never led.

One day after beating Marquette at the buzzer, Butler (3-1) held North Carolina to 18 points in the first half ? by far the worst output in a half for the Tar Heels so far this season.

P.J. Hairston led UNC with 15 points. Marcus Paige and Reggie Bullock each scored 13.

Andrew Smith had 13 points for Butler, while Kyhle Marshall had 10 points and 11 rebounds.

Butler got out to a 10-2 lead in just over four minutes then built it to 14 points with a 9-0 run capped by a layup from Erik Fromm with 9:36 left in the first half. Minutes later, Fromm grinned and nodded after hitting a 3-pointer from the top of the key that put Butler up 16 with less than four minutes to go in the half.

Meanwhile, Paige and James McAdoo combined for just nine points in the opening 20 minutes as UNC made only a combined eight shots.

"In the first half, they really kicked us," Williams said. "In the second half, we're trying to make comebacks, but they were making shots."

Butler took a 27-point lead roughly seven minutes into the second half. Duhman hit back-to-back 3s less than 19 seconds apart thanks to a steal and nifty assist from Clarke.

But the talented Tar Heels did not go quietly.

Hairston scored 10 straight ? eight points in just over one minute and screaming after every bucket ? to pull Carolina within 17 with 9:39 to go. Chase Stigall responded with back-to-back 3-pointers in the next two minutes.

Carolina pulled within six with less than two minutes left after scoring eight points in just over 40 seconds, including six from Paige.

But Butler hit five free throws in the last 1:01 to nail down the win.

Butler, on a roll in the Aloha State since losing 62-47 at Xavier one week ago, will play either Illinois or Division II Chaminade in the tournament's title game on Wednesday. UNC will get the loser of that matchup in the third-place game.

Butler ? an unranked squad which dropped from all ballots in the last AP Top 25 tally ? pulled off a win over Marquette to open the tournament with an improbable, running 3-pointer from Clarke.

Stevens said its second win in Maui taught his team an early-season lesson about getting off to a fast start.

"You know that you have got to play attacking the rest of the game," he said.
