Joseph O'Brien has been arrested 24 times since 1995.

An Illinois man registered as a sexual predator by the state was arrested earlier this month after he was caught loitering inside the children's play area of a McDonald's restaurant near suburban Elk Grove Village.

Joseph O'Brien, 36, was arrested on Dec. 22 after the restaurant's manager called in a complaint to police, the Daily Herald reports. He has been charged with criminal trespassing and failing to update his address to police.

According to the Cook County Sheriff's Office, O'Brien had reportedly been staring at an 11-year-old girl inside the play area and had been asked to leave the restaurant on several other occasions, CBS Chicago reports.

Per the Chicago Tribune, O'Brien has been arrested 24 times dating back to 1995 and was convicted in 2001 of aggravated sexual abuse and bodily harm. The Illinois state sex offenders' registry lists an address in Des Plaines, Ill., but officials said he had been staying at a motel near the McDonald's restaurant.

O'Brien's bond was set at $75,000 and he is in custody at Cook County Jail.

Junior Dos Santos vs. Cain Velasquez: The Rematch Will Outdo the First Fight

The rematch between Junior dos Santos and Cain Velasquez will go down in the main event of UFC 155.? It may be one of the most talked-about rematches in recent memory, given how their first meeting ended.

Velasquez and dos Santos met one another on the first-ever UFC card on the Fox network in Nov. of 2011. After a 30-minute pre-match lead-in, fans were hoping for an epic battle between two of the best heavyweights on the planet.

Instead, the end came swiftly, just 64 seconds into the contest.

Velasquez didn't quite look like himself, and the knee injury he had coming in likely played some part in his performance. But he also looked very tentative as well, something we hadn't seen from a guy who likes to push the pace, given his conditioning advantage over most heavyweights.

Dos Santos, to his own credit, fought with a damaged knee as well. He was able to land an overhand right to end the fight and capitalize on the opening for the finish.

Now both men will meet one another Saturday night to decide the future of the heavyweight division. Will the rematch play out in similar fashion?

Luckily, there's hope for a better fight the second time around.

For one, just as in team sports, it's very hard to dominate an opponent a second time. Both men have learned what to do and what not to do coming into the rematch. Training for months on end for the same opponent no doubt makes each man an expert on the other.

Another reason the rematch should outdo the first is Velasquez.

The former champion seems to have a different mindset coming into the rematch. Listening to him in the pre-fight interviews, Velasquez seems to realize he needs to be more aggressive and not wait for the champion to make the first move. As a popular saying in professional wrestling goes, "The challenger needs to beat the champion, a champion doesn't need to beat his challenger."

Velasquez knows he needs to come out and take the title from dos Santos, which should lead to some explosive striking exchanges. Or even better, Velasquez may get a takedown and make the champion fight off his back, something we've yet to see from dos Santos thus far in his UFC career.

With so many variables coming in, the rematch is bound to create just as much?if not more?anticipation for how the fight will play out. And, of course, greater anticipation creates greater interest in the fight.

It's very rare that a rematch ends in similar fashion as the first meeting, but given JDS' punching power, that could be a real possibility. Still, Velasquez seems to be focused on getting his belt back and won't go down without a fight this time.

Those who were faking the funk as far as how many YouTube views they have are in for a rude awakening, as YouTube is cracking down on the fake views that people have purchased.

Universal is taking the biggest hit, as the channel which features music videos from Rihanna, Nicki Minaj, and Justin Bieber lost more than one billion of its seven billion views.

Sony was also hit hard, losing more than 850 million views in one day.

?

The confiscation of the views comes after statistic analysts at SocialBlade conducted an audit of YouTube?s view counts, in an attempt to curb the black hat techniques to boost view counts.

?

Many artists and labels artificially build up view counts on YouTube videos in order to create a pseudo-buzz, using the philosophy that people will follow what?s popular.

?

In other words, when people see a high YouTube view count, they assume that the song is good and have a positive association with the song before hearing it.

?

YouTube does not permit artificial view count boosters.

?

?This was not a bug or a security breach. This was an enforcement of our viewcount policy,? YouTube said in a statement.

Now artists will have to earn their views. Maybe that artist isn?t as popular as you previously thought!

I unfollowed GigaOm's Mathew Ingram (a fine writer) on Twitter some time ago because I could not muster any more interest in articles about articles and blog posts about blogging. I believe that journalists (like people in most professions) vastly overestimate their own importance, significance, and interestingness. But I suppose if I'm going to go meta, an end-of-the-year post seems an appropriate venue; and for once I have something both meta and relevant to talk about.

Stomach bug knocks Nadal from Australian Open

MADRID (AP) ? Rafael Nadal will miss the Australian Open because of a stomach virus, further delaying his comeback after being sidelined since June.

The Australian Open, the year's first Grand Slam tournament, begins Jan. 14. The virus kept Nadal from making his return at Abu Dhabi this week.

The Spaniard said Friday his withdrawals had nothing to do with the tendinitis in his left knee, which forced him to take a break last summer following his second-round loss at Wimbledon to then 100th-ranked Lukas Rosol. Nadal also missed the London Olympics.

"My knee is much better and the rehabilitation process has gone well as predicted by the doctors," Nadal said in a statement. "But this virus didn't allow me to practice this past week, and therefore I am sorry to announce that I will not play in Doha and the Australian Open."

The former No. 1 player hopes to return at Acapulco, Mexico, starting Feb. 27. However, he did not rule out playing an earlier tournament if his recovery went well enough.

"I always said that my return to competition will be when I am in the right conditions to play," he said. "And after all this time away from the courts, I'd rather not accelerate the comeback and prefer to do things well."

Nadal, ranked No. 4, won the Australian Open in 2009. Last year, he lost to top-ranked Novak Djokovic in a title match that lasted 5 hours, 53 minutes, the longest recorded Grand Slam final.

Nadal's doctor, Angel Ruiz-Cotorro, said in the statement that Nadal needed at least a week to recover from the virus, ruling him out for the Qatar Open set to start on Jan. 2.

And Nadal's coach and uncle, Toni Nadal, explained that Nadal had opted against making his return at Melbourne since he wouldn't be physically fit to take on its five-set format.

"We consider not appropriate to play the Australian Open since we will not have enough preparation for a greater competition which is a Grand Slam tournament," said Toni Nadal in the statement. "It is simply not conceivable that his first event is a best of five sets event, he wouldn't be ready for that."

Nadal's knee injury prevented the 11-time Grand Slam winner from defending his Olympic singles gold at last summer's London Games, where he was supposed to be Spain's flag bearer in the opening ceremony.

He also had to pull out of the U.S. Open and Spain's Davis Cup final against the Czech Republic, and his teammates lost without him.

Tissue Study Could Reshape Advanced Prostate Cancer Treatment ...

A comprehensive study of prostate cancer tissue done in the UK has revealed that a completely new gene network takes over driving the cancer in men who are castrate resistant. The research was published in Cancer Cell.

Researchers at the Cancer Research UK Cambridge Research Institute, at the University of Cambridge studied tissue samples from men with prostate cancer. They found that a protein fuels advanced prostate cancer (castrate resistant) by switching on a different set of genes previously not linked with the disease. This research might provide new drug targets to treat the disease and new bio-markers that could be used to monitor progression of advanced prostate cancer.

Previous cell studies have shown that the androgen receptor attaches to and ?switches on? specific genes to drive cancer. This study shows that when androgens are absent from the bloodstream, or when men are on ADT, the androgen receptor continues to fuel the disease by switching on a completely different gene set. This includes genes associated with the production of glucose and fat.

Study author, Naomi Sharma, Urology Academic Registrar at Addenbrooke?s Hospital based at the Cancer Research UK Cambridge Research Institute, said: ?This is the first comprehensive tissue study of its kind and shines a new light on the biology of prostate cancer.

?Our understanding so far comes from studies in cells grown in the laboratory. In this sophisticated study using samples directly from patients, we?ve uncovered a much more complex network of cell messages. These messages switch on a completely different set of genes that continue to drive the disease in men for whom standard hormone treatments have stopped working.

?These important findings might provide new targets for the development of new drugs to treat advanced stages of prostate cancer, and new ?flags? to help doctors track the progression of the disease in patients.?

This study is significant as it might change our understanding of how the most important androgen receptor actually works to drive castrate resistant prostate cancer.
Professor Malcolm Mason, Cancer Research UK?s prostate cancer expert, said: ?This fascinating research reframes our understanding of how the androgen receptor works ? painting a very different picture of how it drives cancer.

LAS VEGAS (AP) ? A prosecutor says blood was found in a car borrowed by a woman last seen with a missing 10-year-old girl and later arrested in a razor blade slashing of a co-worker at a Las Vegas Strip casino.

Police investigating the disappearance Jade Morris expect to know Friday whether her body is the one found by a person walking a dog in an undeveloped North Las Vegas housing tract.

Jade was last seen Dec. 21.

Clark County Coroner Michael Murphy says he's awaiting results of DNA testing before saying whether the body is Jade Morris.

Prosecutor Robert Daskas convinced a judge Friday to raise bail to $600,000 for Brenda Stokes Wilson.

Wilson is jailed in the slashing case and is expected to face murder and kidnapping charges in Jade Morris' disappearance.

World stocks, euro down after U.S. "cliff" comments

NEW YORK (Reuters) - World stocks and the euro turned lower on Thursday following comments from the U.S. Senate majority leader that the economy may be poised to go off the "fiscal cliff," while the yen hit a two-year low on expectations a new government in Tokyo will push for aggressive monetary stimulus.

Democrat Harry Reid criticized Republicans for refusing to go along with any tax increases as part of a U.S. budget remedy and said the economy seemed to be heading over the "fiscal cliff" of impending tax hikes and spending cuts.

Economists warn that the $600 billion in higher taxes and spending cuts set to kick in from January could push the world's largest economy into recession, dragging other countries with it.

U.S. stocks fell to session lows after Reid's comment, while world stocks dipped into negative territory and the euro turned negative against the U.S. dollar.

On Wall Street, the Dow Jones industrial average <.dji> was down 99.38 points, or 0.76 percent, at 13,015.21. The Standard & Poor's 500 Index <.spx> was down 12.03 points, or 0.85 percent, at 1,407.80. The Nasdaq Composite Index <.ixic> was down 20.46 points, or 0.68 percent, at 2,969.69.

The MSCI global index <.miwd00000pus> was down 0.3 percent, while European shares <.fteu3> were off 0.04 percent as trading resumed after the Christmas holiday break.

"Unfortunately, a term all of us are sick of hearing - the 'fiscal cliff' - appears to be dominating all aspects of the financial market and consumer confidence," said Joe Heider, principal at Rehmann Financial in Cleveland, Ohio.

EURO DIPS, YEN SLUMPS

The dollar rose to 85.92 yen, its highest since August 2010. It was last up 0.4 percent on the day at 85.91 yen with option barriers cited at 86 yen and stop-loss buy orders above 86.10 yen.

Investors accelerated their yen sales after Prime Minister Shinzo Abe said his newly formed government would pursue a bold monetary policy, a flexible fiscal policy and a growth strategy to encourage private investment.

The yen has fallen roughly 10.5 percent versus the dollar in 2012, its biggest annual drop since 2005. At the same time, Japan's benchmark Nikkei is now up 22 percent for the year.

"Yen weakness, based on expectations that the new Japanese government will succeed in driving the dollar to 90 yen with a combination of more aggressive monetary and fiscal policy, is offering support to other currencies," said Marc Chandler, global head of currency strategy at Brown Brothers Harriman in New York.

The euro touched New York lows of $1.3214 following Reid's comments. It last stood at $1.3215, flat to slightly lower on the day.

The euro tends to benefit when U.S. budget negotiations run smoothly, but when there are snags, investor flows go into the safe-haven and highly liquid dollar.

U.S. BONDS TURN POSITIVE

Prices on longer-dated U.S. Treasuries turned positive after the Reid comments.

The bond market began trimming its decline earlier on data that showed a bigger-than-expected drop in American consumer confidence in December, spurring worries about flagging consumer spending causing a U.S. recession.

Benchmark 10-year Treasuries prices were 10/32 higher in price, yielding 1.7147 percent, compared with being down by 2/32 before the confidence data and Reid's remarks.

An NFL Penalty Box

Last week, Patrick Chung (of my beloved New England Patriots) laid a vicious helmet-to-helmet hit on Jacksonville Jaguars receiver Cecil Shorts III during the final drive of a tight game. New England took a 15-yard penalty for the dirty hit, but Shorts was done for the day. A few plays later, Chung made the interception that ended the game.

Football has its hands full with the head-injury crisis, as every week brings more lawsuits and more damaged former stars. The NFL has instituted new medical regimens to protect concussed players, and made refs crack down on the most dangerous hits. But it hasn?t considered an obvious step that would deter dirty play: a penalty box.

Like the NHL, pro football should force teams to play a man down after a flagrant foul?on top of the usual 15-yard penalty and automatic first down. There are a few ways a NFL penalty box could work: The penalized player could sit out until the next first down (which could be just a single play), or until the next change of possession, (which could be 15 plays), or a set number of plays. The NFL could even borrow the red card from soccer: Not only is the dirty player thrown out of the game, but his team plays a man short for the duration. This feels like a nuclear option to me, but if nothing short of it stopped this kind of hit, why not give it a try?

I?d stay non-nuclear at first though: Cut the team to 10 players on the field for a set number of plays, maybe two for a minor flagrant hit and five for a major one. As with an NHL power play, if the man-up team scored, the penalty would end.

The advantage of an extra man would be enormous in football. Most NFL offensive schemes are designed to achieve a man advantage in a particular part of the field. The penalty box would guarantee that advantage.

The penalty box would undoubtedly need tinkering. Would it work if the offensive team committed the flagrant hit and went a man down? Would it create a too-big advantage, requiring other rule adjustments? As the NHL icing rule is suspended during a penalty, would the NFL need to put in rules making the passing game tougher (tighter intentional grounding rules, or tweaks that make pass blocking harder, so quarterbacks have less time to target a downfield receiver)?

That kind of rebalancing toward the defense would probably have to be hashed out over several seasons, and it might get messy. It seems worth it, though, because the protections in place right now for receivers aren?t working.

Weird Science 2012: Sex, drugs and doomsday

Videos from the University of California at San Francisco show how researchers studied the alcohol consumption habits of lovelorn fruit flies in one of 2012's weirdest experiments.

Sex, drugs, rock 'n' roll and the Apocalypse: 2012 had it all. But only 10 stories about the past year's strangest scientific research can make it into our Weird Science hall of fame???so we're going to need your help.


Past winners of the Weird Science Awards include glow-in-the-dark kittens and puppies, a 2,700-year-old marijuana stash, meth-crazy fruit flies, reattached rabbit penises and the corpse-dissolving machine. The Maya apocalypse came in for honorable mention last year?and the year before, but this could be an even bigger year for end-of-the-world weirdness.

There are lots of other contenders from 2012, however. It's hard to beat the story about the sex-starved flies who drowned their sorrows in alcohol while researchers watched. That covers sex and drugs. It also can make you feel sorry for the scientists who had to watch all that fly-sized heartbreak. (They might want to compare notes with the researchers who studied why alcohol makes people feel good.)

The sixth annual Weird Science Award competition follows the precedent we've set in past years: We offer up 30 nominees from the past year, and it's up to you to pick the top 10. We've included one of the studies that won an?Ig Nobel award. honoring for "research that makes people laugh ? and then think." That's a fine criterion for the Weirdies as well. Or you can go with research that makes you laugh ? and then makes you wonder, "What on earth were they thinking?"

Write-in votes and second-guessing are encouraged; you can register them in your comments. If a write-in vote gets enough support from commenters, the research in question will be added to the ballot.

The 10 nominees that get the most votes as of noon ET Jan. 2 will be the 2013 winners of the Weirdy Awards. Later that day, we'll discuss this year's crop of weird science with Ig Nobel creator Marc Abrahams on "Virtually Speaking Science," a talk show that plays out on the Web and in the Second Life virtual world. Eyes may provide a look into multiple sclerosis progression

Dec. 24, 2012 ? New research suggests that thinning of a layer of the retina in the eyes may show how fast multiple sclerosis (MS) is progressing in people with the disease. The study is published in the Jan. 1, 2013, online issue of Neurology?, the medical journal of the American Academy of Neurology.

"This study suggests that retinal thinning, measured by in-office eye scans, called OCT, may occur at higher rates in people with earlier and more active MS," said Robert Bermel, MD, with the Cleveland Clinic Mellen Center for MS and a member of the American Academy of Neurology, who wrote an accompanying editorial.

For the study, 164 people with MS from the Johns Hopkins MS Center, including 59 who had no disease activity, underwent eye scans that measured thinning of a portion of their retinas every six months for an average of 21 months. Participants were also given MRI brain scans at the start of the study and yearly.

The study found that people with MS relapses had 42 percent faster thinning than people with MS who had no relapses. People with MS who had inflammatory lesions called gadolinium-enhancing lesions experienced 54 percent faster thinning and those with new T2 lesions had 36 percent faster thinning than MS patients without these features of MRI activity.

People whose level of disability worsened during the study experienced 37 percent more thinning than those who had no changes in their level of disability, and those who had the disease less than five years showed 43 percent faster thinning than those who had the disease more than five years.

"As more therapies are developed to slow the progression of MS, testing retinal thinning in the eyes may be helpful in evaluating how effective those therapies are," said study author Peter Calabresi, MD, with Johns Hopkins University School of Medicine in Baltimore and a Fellow of the American Academy of Neurology.

The study was supported by the National Multiple Sclerosis Society, the National Eye Institute and Braxton Debbie Angela Dillon and Skip Donor Advisor Fund.

NEW ORLEANS (AP) ? Forecasts of snow, sleet and freezing rain threatened to complicate Christmas Day travel around the nation's midsection Tuesday as several Gulf Coast states braced for a chance of twisters and powerful thunderstorms.

In Alabama, the director of the Emergency Management Agency, Art Faulkner, said he has briefed both local officials and Gov. Robert Bentley on plans for dealing with a possible outbreak of storms.

No day is good for severe weather, but Faulkner said Christmas adds extra challenges because people are visiting unfamiliar areas and often thinking more of snow than possible twisters.

"We are trying to get the word out through our media partners and through social media that people need to be prepared," Faulkner said

During the night, flog blanketed highways at times in the Southeast, including arteries in Atlanta where motorists slowed as a precaution. Fog advisories were posted from Alabama through the Carolinas into southwestern Virginia.

Boosting galactan sugars could boost biofuel production

Dec. 21, 2012 ? Galactan is a polymer of galactose, a six-carbon sugar that can be readily fermented by yeast into ethanol and is a target of interest for researchers in advanced biofuels produced from cellulosic biomass. Now an international collaboration led by scientists at the U.S. Department of Energy (DOE)'s Joint BioEnergy Institute (JBEI) has identified the first enzyme capable of substantially boosting the amount of galactan in plant cell walls.

Unlike ethanol, advanced biofuels synthesized from the sugars in plant cells walls could replace gasoline, diesel and jet fuels on a gallon-for-gallon basis and be dropped into today's engines and infrastructures with no modifications required. Also, adanced biofuels have the potential to be carbon-neutral, meaning they could be burned without adding excess carbon to the atmosphere. Among the key challenges to making advanced biofuels cost competitive is finding ways to maximize the amount of plant cell wall sugars that can be fermented into fuels.

"We have confirmed the identity of the GT92 enzyme as the first enzyme shown to increase the biosynthesis of galactan," says Henrik Scheller, vice president for JBEI's Feedstocks Division and director of its Cell Wall Biosynthesis group. "This identification of the first ?-1,4-galactan synthase provides an important new tool for the engineering of advanced bioenergy fuel crops."

Scheller, who also holds an appointment with DOE's Lawrence Berkeley National Laboratory (Berkeley Lab), is the corresponding author of a paper in the journal Plant Cell that describes this work. The paper is titled "Pectin Biosynthesis: GALS1 in Arabidopsis thaliana is a ?-1,4-Galactan ?-1,4-galactosyltransferase." Co-authors were JBEI's April Liwanag, Berit Ebert, Yves Verhertbruggen, Emilie Rennie, Carsten Rautengarten, and Ai Oikawa, plus Mathias Andersen and Mads Clausen of the Technical University of Denmark.

Galactans are polysaccharide components of pectin, the sticky sugar substance that binds together the individual cells in plant cell walls and is used to make jellies and jams. The ?-1,4-galactan component of pectin is especially abundant in the "tension wood" that forms in cell walls in response to mechanical stress from wind or snowfall.

"Galactans are composed of hexoses, which in contrast to pentoses, are easily utilized by fermenting microorganisms for the production of biofuels and other compounds," Scheller says. "It would be advantageous to develop plants with increased galactan content instead of hemicelluloses consisting largely of pentoses."

GT92 is a family of glycosyltransferase proteins whose genes are found in all plants that have been genetically sequenced. An increased expression of GT92 genes has been observed in studies of tension wood. This observation combined with the knowledge that tension wood is rich in ?-1,4-galactan led Scheller and his colleagues to investigate the function of GT92 proteins in Arabidopsis thaliana, a small flowering relative of mustard that serves as a model organism for plant studies. Arabidopsis has three members of GT92, which Scheller and his colleagues designated as GALACTAN SYNTHASE 1,2 and 3 (GALS1, GALS2 and GALS3). While loss-of-function mutants in all three genes were found to be galactan deficient, Scheller and his colleague isolated and tested GALS1.

"Overexpression of GALS1 resulted in plants with 50-percent higher ?-1,4-galactan content and no adverse phenotype," Scheller says. "We expect that the results for GALS2 and GALS3 overexpressors will be similar though we have yet to test them."

Given that all three Arabidopsis GALS genes showed overlapping but not identical expression, Scheller and his colleagues are now combining mutations of GALS genes to better understand the role of ?-1,4-galactan in plants. They're also carrying out basic studies on these enzymes, including crystallization and structural analysis. In addition, they're overexpressing the GALS proteins in different combinations to determine if even higher production of ?-1,4-galactan results.

"As ?-1,4-galactan is an ancient invention, the function of GT92 as a galactan synthase in Arabidopsis should also be applicable to switchgrass, Miscanthus, poplar and other plants being considered as crops for advanced biofuels," Scheller says. "We do not anticipate any difficulty in being able to overexpress GT92 genes in these plants."

Memorial service for Sen. Inouye held in Hawaii

HONOLULU (AP) ? The late Sen. Daniel Inouye was remembered Sunday as an American hero whose legacy as a war veteran and longtime senator would be felt across Hawaii for years to come.

The memorial service at Honolulu's National Memorial Cemetery of the Pacific was attended by about 1,000 people, including President Barack Obama, Senate Majority Leader Harry Reid, Hawaii's congressional delegation and a number of other senators, cabinet secretaries and other dignitaries.

"Daniel was the best senator among us all," Reid told those assembled, adding later: "Whenever we needed a noble man to lean on, we turned to Sen. Dan Inouye. He was fearless."

The cemetery, a strikingly beautiful site located in an extinct volcano, is the final resting place to thousands of World War II veterans. More than 400 members of the storied Japanese-American 442nd Regimental Combat Team ? of which Inouye was a part ? are buried at the site.

Adm. Samuel Locklear, commander of the Navy's U.S. Pacific Command, said this also will be Inouye's final resting place.

"We have lost an irreplaceable American," he said.

Several 442nd veterans attended the Sunday morning service, the latest in a number of tributes and honors for Inouye following the 88-year-old's Dec. 17 death from respiratory complications.

Buses that brought people to the service flashed the words "MAHALO Senator Daniel K. Inouye" ? using the Hawaiian word for thank you.

A 19-gun cannon salute was fired as Inouye's coffin arrived at the cemetery. The service also featured a flyover by F-22 military jets and the playing of "Taps" by Democratic Sen. Jon Tester of Montana.

Inouye's widow, Irene, who was seated with the president and first lady Michelle Obama in the front row, dabbed her eyes as a band of bagpipes and drums band played "Danny Boy."

Inouye was the first Japanese-American elected to both houses of Congress and the second-longest serving senator in U.S. history, at 50 years.

He was a high school senior in Honolulu on Dec. 7, 1941, when he watched dozens of Japanese planes fly toward Pearl Harbor and other Oahu military bases to begin a bombing that changed the course of world events.

He volunteered for a special U.S. Army unit of Japanese-Americans and lost his right arm in a battle with Germans in Italy. That scratched his dream of becoming a surgeon and he went to law school and into politics instead.

"He was a shining star of the greatest generation," fellow Hawaii Democratic Sen. Daniel Akaka said at the service.

Akaka, who served with Inouye for 36 years, also highlighted Inouye's role in steering federal money to build roads, schools, housing and other infrastructure in Hawaii over the decades, from the beginning of statehood.

"Dan Inouye is Hawaii, and Hawaii is Dan Inouye," Akaka said.

Inouye's chief of staff, Jennifer Sabas, said Inouye was calm, in control and giving out instructions until the very end. Then, "he penned 'aloha,' and went on to a better place," she said.

"Aloha, boss," she said in closing, as she stood beside his flag-draped coffin.

Several services have already been held in Washington and in Hawaii for Inouye. He lay in state at both the U.S. Capitol Rotunda on Thursday and the Hawaii state Capitol on Saturday. A public service is planned for Friday on Kauai. His burial is expected to be a private, family event.

Obama eulogized Inouye during a service at Washington's National Cathedral on Friday, saying that Inouye's presence during the Watergate hearings helped show him what could be possible in his own life.

The president arrived early Saturday in Honolulu for his annual Christmas family vacation. He made a brief visit to the grave of his grandfather, World War II veteran Stanley Dunham, after Sunday's service.

Broadband gets a boost with top hat | Community | Surf Coast Times ...

More Torquay and Leopold households and businesses have access to fixed-line broadband after Telstra completed its roll-out of ?top hats? in the area.

The upgrades, which are installed on top of the existing streetside cabinets, increase the number of people who can connect to ADSL2+ internet. Until now, the existing cabinets had not been able to support ADSL2+ technology due to physical constraints.

Telstra Country Wide?s area general manager for Geelong and the Surf Coast, Duane Dalton, said the top hat was an innovative way of improving internet access for residents and businesses.

?In the past year we?ve installed six of these across Torquay and Leopold, representing a significant investment in the area.?

The upgrade also involved improving the connection between each streetside cabinet and the main network to help remove potential bottlenecks. Telstra says the top hats were part of a nationwide infrastructure investment across the country, and the company will continue to invest in innovative communications solutions to bring faster broadband speeds and improved technology where possible.

Mr Dalton said the upgrade would help Telstra customers connect devices such as TVs, computers, smartphones and tablets.

?It will enable our customers to access Foxtel on T-Box and have better access to a range of BigPond content, movies and channels.

?We can also arrange for one of our T-Plus service technicians to come into customers homes and professionally set all these devices up.?

Under the federal Lilly Ledbetter Fair Pay Act of 2009, employees who believe their paychecks reflect a discriminatory pay decision made years or even decades ago can still sue. The legal rationale: That each subsequent paycheck was theoretically lower than it should have been and each pay period amounts to a new violation.

However, that principle doesn?t apply if an employee pursues a state pay discrimination claim under the Texas Commission on Human Rights Act. Instead, employees have to file a complaint within 180 days of the discriminatory pay decision, not from the date of the last paycheck.

Recent case: Diljit, a woman of Indian national origin, is a professor at Prairie View A&M University. She began working for the university in 1987 and applied for a promotion from associate professor to full professor in 2003. Initially denied, she reapplied the following year and was promoted. However, she thought her salary was too low because of discrimination. The university refused to raise Diljit?s pay, citing budget constraints.

Diljit did nothing for several years, but finally filed complaints with the EEOC and the Texas Workforce Commission. She claimed a continuing violation and said her paychecks reflected discrimination every payday.

The case ended up in the Texas Supreme Court. The university argued that Diljit should have filed her complaint within 180 days of the promotion.

The court agreed. It said that while the U.S. Congress made an exception for late pay discrimination claims by enacting the Ledbetter Act, the Texas Legislature didn?t follow suit. Therefore, state pay discrimination claims must commence within 180 days of the original alleged discriminatory act. (Prairie View A&M University v.
